Processing of (personal) data by the entity in charge of the online application process

We at POSpulse GmbH (“POSpulse”) take our data protection responsibility very seriously. Therefore, protecting your privacy and your personal data is very important to us. That is why we would like to provide You with this privacy policy in which we present You our online data practices as well as your options regarding collecting and using your personal data.
The www.pospulse.com website (“Website”) is operated by POSpulse. POSpulse is the responsible office for personal data of Website users (“You”).
In the following, we would like to explain to You in further detail which personal data is collected by whom during your visit to our Website and how this data is used. We collect, process, and use your personal data in agreement with the content of this privacy policy as well as the applicable data privacy laws.
1. Collecting and processing personal data
By the term “personal data,” we mean all individual information about personal or material circumstances of a specific or identifiable natural person. This includes information such as your name, your address, or your telephone number.
Information that is merely statistical or aggregated that cannot be associated with You such as the number of users of a page is not personal data.
1.1. User data automatically collected from visits to our Website
If You do not sign up, register, or transmit information to us in some other way while using the Website, POSpulse only collects data – like every other website – that your browser automatically transmits to make it possible for You to visit our Website.
The following data are included
  • IP address (internet protocol address) of the computer from which the Website was accessed
  • Name of the files and/or information that were accessed
  • Date, time, and duration of access
POSpulse stores IP addresses and/or information of the above type for a limited time for security reasons (for example to identify attack attempts).
1.2. Personal data for conducting orders
POSpulse collects the following customer personal data for conducting orders:
  • First and last name
  • Company name
  • Email address
  • Telephone number (landline and cell phone)
  • Position in the company
POSpulse uses customer personal data for conducting orders exclusively for the following purposes:
  • Communicating with customers, requests
  • Customer management
  • Creating a company profile in the back end of the analytics dashboard upon which customer access to the back end of the analytics dashboard is based
  • Accounting
  • Providing product and service information to customers
  • Determining customer experiences and opinions related to POSpulse products and services to the extent permitted by law
1.3. Personal data for newsletters
You can sign up to receive our newsletter by email by your express consent. We use HubSpot to do so, which is described under Section 4.3. Your IP address and the time are stored when You register for the newsletter along with the confirmation thereof so that we can verify registration in cases of doubt. In the event that You register for the newsletter, we collect the following data:
  • Email address
  • First and last name
  • Your consent
You can cancel the newsletter anytime at presse@pospulse.com.
1.4. Other personal data
In addition to the above-stated user data, POSpulse collects and processes personal data if You provide them to us such as if You contact us by email or fill out a Website form. In this respect, the following personal data can especially be collected:
  • First and last name
  • Email address
  • Content of your message to us
  • Position and company
  • Other company data such as mailing address, number of employees, or current challenges (if protected as personal data according to applicable data protection law) 
2. Purposes of using personal data
POSpulse uses your personal data apart from the purposes already listed above for the following purposes (only to the extent required to do so):
  • Providing and technically managing Website contents
  • Misuse/fraud prevention
  • Our own advertising to the extent permitted by law
  • Improving our web presence
3. Disclosing data to third parties; integrating service providers
Personal data of Website users and our customers is generally only disclosed to third parties if this is required for the purpose of contract processing (such as regarding payment service providers), or if express consent was issued.
However, POSpulse can also utilize service providers (who are not third parties as defined by data privacy law) for collecting and/or processing and using personal data. The service providers are contractually obligated as contract data processors to process data only for the purposes determined by POSpulse (and not for their own or any other purposes) and at the direction of POSpulse (see also Section 4). POSpulse has concluded appropriate what are called data processing contracts with all contract data processors, which ensure this.
Service providers only receive personal data from POSpulse that they require for their specific activity. For example email addresses can be disclosed to a service provider such as HubSpot (see also Section 4.3) so that HubSpot can deliver the POSpulse newsletter. Service providers may also be commissioned to provide data center services (within the EU) to evaluate the user-friendliness of our Website, or to perform technical support. With a few exceptions (see Sections 4.2 and 4.3 below), all of these service providers have their registered office in the EU or in the European Economic Area. If in exceptional cases service providers have their registered office outside of the EU or the European Economic Area, POSpulse has taken actions to ensure that all of these persons and organizations respect your privacy and protect personal data only in agreement with the requirements of applicable data protection law.
In this regard, it is also important for us to emphasize that service providers may not disclose your data to third parties (or sub-contracted data processors) without the consent of POSpulse. Personal data is only transmitted to government agencies or other government institutions if data protection law permits it and if it is required by mandatory national legislation.
4. Cookies and similar technologies
4.1. General information on cookies
This Website uses what are called cookies to make your use of the Website as comfortable as possible. Cookies are text files that are transferred by internet browsers while the Website is accessed. Cookies are automatically stored on your device. Cookies help us to design this Website in a more user-friendly way. You can deactivate cookies in the settings of your internet browser, which however can have a negative impact on functions when using this Website. Therefore, we recommend that You allow our cookies.  4.2. Google analytics
We specifically use the “Google analytics” cookie on our Website. Google analytics is a web analysis service of Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA, “Google”). Google analytics uses cookies that are stored on your device and that make it possible to analyze your use of the Website. On behalf of POSpulse, Google will use this information to analyze your use of this Website, to compile reports about Website activities, and to provide other services related to Website use and internet use to POSpulse. The IP address transmitted from your internet browser by Google analytics is not combined with other data from Google, but it is anonymized by shortening (Google analytics was extended for this Website by the
“gat._anonymizeIp” code to guarantee anonymized collection of IP addresses (what is called IP masking)). Data collected by Google analytics is also not used by POSpulse to personally identify visitors to this Website and is not combined with personal data. You can deactivate cookies in the settings of your internet browser, which however can have a negative impact on functions when using this Website (see also Section 4.1 above).

4.3. HubSpot marketing automation tool
We use HubSpot on this Website for registering for newsletters and downloads and to send You emails. We use the HubSpot cookie in some circumstances to analyze your use of our sites so that we can continually improve them. Emails that are sent with the help of HubSpot use tracking technologies. We use this data first and foremost to find out what topics are interesting to You by looking whether our emails are opened and what links You click on.
Then we use this information to improve the emails that we send You and to improve the services that we provide.

6. Duration of the storing of your personal data
We store your personal data as long as it is appropriate and necessary to fulfill the purposes for which it was collected (consent that You give us in this respect also remains valid after the end of our business relationship with You) as well as to comply with applicable law.
7. Information, deletion and correction claims
Under data protection law, You have the right upon application to receive free information about the personal data stored about You. In addition You also have the right to correction, blocking, and deletion of this personal data in accordance with statutory provisions.
Upon request we notify You as soon as possible in writing according to applicable law whether and which personal data about You is stored by us. Should false information be stored in spite of our efforts for correctness and currentness of data, we will correct the data at your request.
8. Data security
Our website is SSL encrypted. All data at POSpulse is stored on servers in a German data center. POSpulse and its data center service provider fulfill all of the technical and organizational measures required by law to protect your data in particular from loss, falsification, or access by unauthorized persons in accordance with the current general state of technology.
In the event that You want to contact us by email, we would like to point out to You that confidentiality of the transmitted information cannot be guaranteed. Email content can normally be subjected to surveillance attacks from unauthorized third parties during transfer.

If You follow a hyperlink to one of these websites, please note that we can assume neither responsibility nor a guarantee for third-party contents or data protection terms and conditions, nor can we have any influence thereon. Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual.
